PR urges HC to lift road show ban

Hyderabad Dec. 1: The Praja Rajyam party on Monday urged the AP High Court to vacate the stay on banning road shows by political parties in the state. Mr P. Mitra, the general secretary of the party, filed a counter affidavit pursuant to a court notice regarding a public interest litigation seeking a direction to disallow all political parties from conducing road shows.

Mr Mitra, contended that the court cannot prohibit road shows as it amounted to violation of fundamental rights guaranteed in Article 19 (i) (a) (b) and (d) of the Constitution. He argued that a fundamental right cannot be prohibited but can be only restricted by law. Laws to regulate and restrict such rights existed and these are mentioned in Section 30 of the Police Act 1861 and Section 23 onwards of the Hyderabad City Police Act 1354. Mr Mitra also contended that the petition was not maintainable as right to assemble includes a right to carry out procession.
