Grandparents claim custody

Hyderabad Dec. 1: More and more grandparents are coming forward to claim the custody of their grandchildren to save them from their squabbling parents. At the two family courts of Hyderabad and Secunderabad, there has been an increase in the number of elderly people who are legally trying to win rights to take care of their grandchildren. The courts are also awarding custody of grandchildren to grandparents if they are able to successfully prove that they are in a position to take care of the children. Legal experts say that the trend is on the rise because of the increasing number of divorces these days.

In a recent case, the husband and wife got divorced and the girl child’s custody was given to the mother. But the father’s parents have now submitted a petition at the family court to get the custody of the child. “The grandparents claim that the little child is very attached to them and if they can prove the fact, they might get its custody,” said J. Sudnyata Deepak, advocate at the family court in Secunderabad. The trend is much more evident in the case of children of single mothers whose estranged husbands are away in a foreign country.

“It is mostly the mother’s parents who claim custody of children, and quite a few are getting it,” said Mr Samuel Sundar, a senior advocate at the family court in Hyderabad. Recently, another boy was handed over to his grandparents after he himself expressed his desire to stay with them. The child was asked for his opinion in open court and he indicated that he would rather live with his grandparents than either of his separated parents.
