Divorce still taboo for older couples

Hyderabad, Dec. 10: Many elderly women of the city are seeking maintenance from their husbands without pressing for divorce.

A 65-year-old woman who approached the Family Court at Secunderabad to seek maintenance from her husband is the latest instance of this trend.

She was at her wits end since her husband suspected that she was mixing poison in his food. He had developed a cardiac problem but felt it was because of his wife’s machinations.

In another case, a young woman, unable to bear the physical abuse of her husband everyday, also sought maintenance at the Court but not a divorce.

Many other wives are also seeking maintenance under Section 125 of CrPC, without breaking up the marriage officially.

"This trend is more common among elderly couples, who do not want legal separation since they have no plans to remarry," said J. Sudnyata Deepak, advocate at the Family Court in Secunderabad. "Neither do they want to live together. They want to stay separately and but the wives also want maintenance."

"Most old people consider divorce a taboo so they hesitate to take that step," said Nischala Siddha Reddy, advocate at the Family Court.

"Even if they decide to go separate ways, they think twice and only opt for it once their children are settled," said Ms Reddy.

Depending on the merit of the case, the court usually orders the husband to pay the maintenance for the upkeep of the wife.
